Feelback AI provides a SaaS digital tools ecosystem. We are not intermediaries or participants in commercial transactions between the User and their end customers. Services include:

• Crafted: Digital catalog creation and product display.
• Mesa: On-site and remote order management.
• Feelback: Customer feedback collection and analysis.

By creating an account, the User gains access to a unified control panel. Modules may be activated or deactivated according to the subscription plan. Access is personal and non-transferable; the User is solely responsible for maintaining credential confidentiality.

The User acknowledges that Feelback AI:

• Is not a payment processor: Transactions occur through third parties (Stripe, PayPal, Mercado Pago) or directly between the User and their customer.
• Does not manage logistics: Product delivery or service provision is the sole responsibility of the User.
• Is not responsible for quality: Any complaint, return or warranty on products must be resolved directly by the User.

The User agrees not to use The Services to promote or sell:

• Illegal substances, drugs, chemical precursors or paraphernalia.
• Firearms, explosives or personal defense items.
• Explicit sexual content or pornography.
• Stolen, counterfeit or IP-infringing items.
• Any product or service that violates Mexican law.

Feelback AI reserves the right to suspend or delete any account that violates these prohibitions, with no right to a refund.

The User is solely responsible for:

• Complying with tax obligations (CFDI issuance, income declaration).
• Obtaining necessary administrative or health permits for product sales.
• Complying with the Federal Consumer Protection Law in offers and promotions.

• User content: You retain rights over your product images and texts. By uploading them, you grant Feelback AI a free, global license to display that content strictly for the purpose of providing The Services.
• Feelback AI content: The software, design, interfaces, logos and algorithms of Crafted, Mesa and Feelback are the exclusive property of Palo Duro AI, S.A.S. Reproduction or reverse engineering is prohibited.

• Plans: Costs and benefits of each plan (monthly/annual) are detailed on the website.
• Auto-renewal: Unless cancelled 24 hours before the billing date, the subscription will renew automatically.
• No refunds: Due to the digital nature of the service, no refunds are issued for periods already initiated. Upon cancellation, the User retains access until the end of the paid period.

Since the User uses The Services to manage their own customers' data, the User guarantees they have their own Privacy Notice, have obtained necessary consent to process such data on our platform, and that Feelback AI acts solely as Data Processor for those specific data.

Feelback AI shall not be liable for:

• System outages arising from hosting or internet providers.
• Data loss due to misuse of the account by the User.
• Lost profits or indirect damages arising from platform use.

The User agrees to indemnify and hold Palo Duro AI, S.A.S. harmless from any claim, fine or demand (including legal fees) arising from their commercial activity or breach of these Terms.

For the interpretation and fulfillment of these Terms, the parties submit to the federal laws of Mexico and to the jurisdiction of the competent courts in the City of San Luis Potosí, Mexico, waiving any other jurisdiction.
